2020 Fall Brush Removal

NOTICE TO TOWN OF WHEATLAND RESIDENTS OUTSIDE VILLAGE OF SCOTTSVILLE – 2020 Fall BRUSH REMOVAL

The Town of Wheatland D.P.W. will pick up brush at each resident’s home. Brush pick-up will start on Monday, October 19, 2020. We will do the town residential areas first:

a. Hamlet of Mumford
b. Rolling Acres

After the residential areas are done, we will start at the west end of Town and work east to cover the outlying areas.

– Brush must be neatly piled, butt ends in same direction
– 1 truck load per household Residential brush only
– No fence row material, such as trees or large stumps
– No brush over 6 inches in diameter. 

ONCE A ROAD OR STREET IS DONE, THERE WILL BE NO RETURN TRIP.

COLLECTION OF REFUSE AND RECYCLABLES

The previous dates advertised for the acceptance and award of the refuse district bid have been postponed after an amendment has been made to the “Terms and Conditions for Bid Proposal and Agreement for Collection of Refuse and Recyclables”. Please see new dates and times below.

Notice is hereby given that bids are being solicited for the collection of refuse and recyclables from the following Refuse Districts in the Town of Wheatland for the calendar years 2021-2022 (2-year bid) and 2021-2023 (3-year bid).

Mumford Refuse District: 267 collection units
Rolling Acres Refuse District: 68 collection units
Fairview Road Refuse District 20 collection units

Sealed bids for each collection year will be received at the Office of the Town Clerk, Town of Wheatland, 22 Main Street, Scottsville, New York. Bids will be received until 12:00 p.m. Thursday, September 24th, 2020 and shall be opened publicly on said date at a Special Meeting of the Town Board at 5:00 P.M. Bids will be awarded at the Special Meeting of the Town Board on Thursday, September 24th, 2020 at 5:00 P.M.

VILLAGE OF SCOTTSVILLE
NOTICE OF ADOPTION OF RESOLUTION

The Board of Trustees of the Village of Scottsville and the Town Board of the Town of Wheatland, Monroe County, New York (The Boards) adopted the following resolution subject to a permissive referendum.

ESTABLISHMENT OF THE WHEATLAND-SCOTTSVILLE JOINT FIRE DISTRICT RESOLUTION

WHEREAS, The Board of Trustees of the Village of Scottsville and the Town Board of the Town of Wheatland, Monroe County, New York (The Boards) having determined it to be in the public interest of the citizens of the Village of Scottsville and those citizens in the Town of Wheatland within the geographic area of the Wheatland Fire Protection District to participate in a joint meeting to consider the proposal regarding the establishment of a joint fire district, to be called the Wheatland-Scottsville Joint Fire District,( Joint Fire District or Fire District ) and

WHEREAS, The Boards having met at such joint meeting held on July 16th , 2020 whereby the Boards determined it to be in the public interest to make the proposal dated July 8, 2020 to establish a joint fire district to be called the Wheatland-Scottsville Joint Fire District, and

WHEREAS, said proposed joint fire district is to encompass the entire Village of Scottsville and the Town of Wheatland excepting those land within the Mumford Fire District all located within the County of Monroe State of New York.

WHEREAS the object and purposes for which it is proposed that a new fire district be created is to provide fire protection within the areas of the proposed Wheatland-Scottsville Joint Fire District, and

WHEREAS, at said joint meeting held on July 16,2020, the Boards determined it to be in the public interest to hold a public hearing on the proposal to establish the Joint Fire District, pursuant to Article 11 and 11-A of the Town Law , encompassing the area as stated herein, and the Boards having set the Public Hearing for this date , and

WHEREAS at said joint meeting held on July 16, 2020 the Boards designated the Town Board of the Town of Wheatland as lead agency for the purposes of environmental review pursuant to the New York State Environmental Quality Review Act (SEQRA) regarding the establishment of the joint fire district, and

WHEREAS, prior to the plan’s adoption the Village and Town requested special legislation from the New York State legislature ,( Assembly bill A10403 and Senate Bill S 8133) , to facilitate the establishment of the joint district , that special legislation’s passage was dubious because of the legislative agenda in Albany having matters of higher priority and importance, and

WHEREAS, recent communication from Albany make the passage of such special legislation possible, though not certain and if such legislation be enacted, it will facilitate the establishment of the fire district, and by the content of the special legislation modify the proposal date July 8, 2020, in certain respects,

WHEREAS, a joint public hearing was held at the Wheatland Municipal Building in the Village of Scottsville, Town of Wheatland State of New York on August 4, 2020 at 6:00 P.M , at which time all persons interested in the establishment of the joint fire district were heard, either in person or remotely, and at the public hearing the proposal of July 8, 2020 was discussed as was the impact of the special legislation on the proposal if passed and made into law, and

WHEREAS the following resolution was presented for discussion at the public hearing:

A RESOLUTION AUTHORIZING THE BOARD OF TRUSTEES OF THE VILLAGE OF SCOTTSVILLE AND THE TOWN BOARD OF THE TOWN OF WHEATLAND, MONROE COUNTY, NEW YORK, TO ESTABLISH A JOINT FIRE DISTRICT TO BE KNOWN AS THE WHEATLAND-SCOTTSVILLE JOINT FIRE DISTRICT, WHICH FIRE DISTRICT WILL ENCOMPASS THE ENTIRE VILLAGE OF SCOTTSVILLE AND THE TOWN OF WHEATLAND EXCEPTING THOSE LAND WITHIN THE MUMFORD FIRE DISTRICT ALL LOCATED WITHIN THE COUNTY OF MONROE STATE OF NEW YORK., SUBJECT TO THE TERMS AND CONDITIONS AS SET FORTH IN THE PROPOSAL DATED JULY 8, 2020, AS MAY BE MODIFIED OR IMPACTED BY SPECIAL LEGISLATION CONTAINED IN ASSEMBLY BILL A10403 AND SENATE BILL S 8133 AND PASSED INTO LAW , AND

WHEREAS, Prior to the adoption of this resolution, the Town Board of the Town of Wheatland , as lead agency, pursuant to SEQRA has determined that the establishment of the joint fire district will not have a significant adverse environmental impact and that a Draft Environmental Impact Statement will not be prepared. Accordingly, The Town Board of the Town of Wheatland pursuant to SEQRA, has issued a Negative Declaration and Notice of Determination of Non-Significance, regarding the creation of such joint district.

NOW THEREFORE BE IT RESOLVED That based upon the evidence given at the public hearing, the prior reports and studies mentioned at such Public Hearing as part of the record and after considering the objections to the Establishment of the Wheatland-Scottsville Joint Fire District and after discussion of the proposal dated July 8, 2020, (as may be modified or impacted by Special Legislation contained In Assembly Bill A10403 and Senate Bill S 8133 ), the Board of Trustees of the Village of Scottsville and the Town Board of the Town of Wheatland, Monroe County, New York ( The Boards), it is in the public interest to hereby establish a joint fire district pursuant to New York State Law , to be known as the Wheatland-Scottsville Joint Fire District, which fire district will encompass the entire Village of Scottsville and the Town of Wheatland excepting those land within the Mumford Fire District all located within the County of Monroe State of New York,

and it is further RESOLVED, That in accordance with the proposal date July 8, 2020, the following five (5) individuals are appointed by the Boards as the initial Board of Fire Commissioners of the Wheatland-Scottsville Joint Fire District, the above appointment to expire on December 31, 2020

On the motion of the Boards, this resolution is subject to a permissive referendum this entire resolution was thereupon duly declared to have been adopted, subject to a permissive referendum, and shall not take effect until 30 days has elapsed after its adoption, or unless approved at a special election of the qualified voters of the Village of Scottsville and the Wheatland Fire Protection District after a proper petition calling for such special election is filed with the Village Clerk of the Village of Scottsville and Town Clerk of the Town of Wheatland within the time permitted by law.

Fire District Dissolution Public Hearing

NOTICE OF PUBLIC HEARING
DISSOLUTION OF WHEATLAND FIRE PROTECTION DISTRICT

Whereas, The Town Board of Wheatland ( Board ) having reviewed and discussed the Dissolution Plan for the Wheatland Fire Protection District for dissolution dated July 16, 2020 and the having determined it is in the public interest to endorse said Dissolution Plan and hold a public hearing to commence the dissolution process, and

NOTICE IS HEREBY GIVEN the a Public Hearing regarding the Dissolution Plan of the Wheatland Fire Protection District will be held by the Town Board of Wheatland for its consideration at a public hearing to be held at the office of the Town of Wheatland at the Wheatland Municipal Building, 22 Main Street, Scottsville , New York 14546 on August 20, 2020 at 6:00 p.m. The public hearing will be held remotely and will allow, at such hearing, all interested persons will be given a reasonable opportunity to be heard on any aspect of the proposed Dissolution of the Wheatland Fire Protection District, said persons to be heard remotely or in person at that location, abiding by the social distancing rules including the wearing of masks.

The Resolution to be considered is as follows:

A brief description of the boundaries of the Wheatland Fire Protection District is the entire Town of Wheatland excluding the entire Village of Scottsville and the area of the Mumford Fire District, all located within the County of Monroe, State of New York.

The Descriptive Summary of the Plan for Dissolution is as follows:

DESCRIPTIVE SUMMARY – PLAN FOR DISSOLUTION

TOWN OF WHEATLAND FIRE PROTECTION DISTRICT MONROE COUNTY. NEW YORK

1. This is the Descriptive Summary of the Dissolution Plan of the Wheatland Fire Protection District endorsed by the Town of Wheatland Town Board on July 16th, 2020.

2. The Wheatland Fire Protection District, within the Town of Wheatland (Town), Monroe County, New York proposes to be dissolved.

3. The territorial boundaries of the Wheatland Fire Protection District are the entire Town of Wheatland 1) excluding the entire geographic area of the Mumford Fire District and the Village of

Scottsville, 2) bounded on the north to the southern boundary of the Town of Chili and the Clifton Fire Protection District; 3) bounded on the east by the western boundary of the Towns of Rush and Henrietta, and 4) bounded on the south at the Monroe County Livingston County Line.

4. The cost of the dissolution would be nominal. The Town will be utilizing some of the town paid staff who are on payroll, this sum being part of the normal operating budget of the Town of Wheatland.

a. After its dissolution, the Town of Wheatland will no longer be required to include appropriations for the Wheatland Fire Protection District.

b. This dissolution is conditioned upon the establishment of the Wheatland-Scottsville Joint Fire District.

5. The Wheatland Fire Protection District has no employees, and thus there be no transfer or elimination of public employees.

6. The Wheatland Fire Protection District has no assets, owns no real and personal property, has no liabilities or indebtedness. As a result of this dissolution, there will be no disposition of the Wheatland Fire Protection District or these assets, property, liabilities, and indebtedness, including the need to levy and collect any necessary taxes.

7. The Town of Wheatland and the Village of Scottsville have entered into an agreement for coordinated review under the State Environmental Quality Review Act with the Town of Wheatland being the lead agent pursuant to SEQRA.

8. The residents who were in the Wheatland Fire Protection District after dissolution, as before the dissolution, will continue to be furnished fire protection by the Scottville Fire Department, Inc.

9. Both the establishment of the Wheatland – Scottsville Joint Fire District and the Dissolution of the Wheatland Fire Protection District will have public hearings.

10. There are no rules or regulations of the Wheatland Fire Protection District that will remain in effect after the effective date of the dissolution.

11. The effective date of the proposed dissolution is December 31, 2020 at 11:59 P.M.

12. This dissolution of the Wheatland Fire Protection District is conditioned upon and dependent upon the establishment of the Wheatland-Scottsville Joint Fire District.

13. A public hearing will be held on this proposed dissolution plan at the Town of Wheatland Town Hall, 22 Main Street, Scottsville, New York,14546 on August 20, 2020 at 6:00 p.m.
