Wheatland – Scottsville Joint Fire District

REGARDING : THE WHEATLAND – SCOTTSVILLE JOINT FIRE DISTRICT

I would like a moment to discuss the notification of a joint public hearing by the Town and the Village governments pertaining to plans to create a joint Wheatland- Scottsville Fire District.

First and foremost, it is important to realize that the same residents who are currently served by the Scottsville Fire Department will continue to receive their fire protection from the same firefighters. These residents are also the same residents who currently carry the financial costs of the building, equipment and other costs such as insurance, etc. A portion of Village taxes cover these expenses and a portion of the Town taxes labeled as “Wheatland Fire Protection” on the Town tax bill pay the remainder of the costs. Therefore, the same residents will continue to bear the costs for the service whether it’s a department of the Village or a district.

The current Scottsville Fire Department is a department of the Village just as the assessor is a department of the Town. Hence, the Village Board serve as the Commissioners for the Fire Department. All spending, debt and planning is entrusted to the Village Board. The Town pays a portion of Village office staff salaries as part of the service they provide to the current fire department. Although Town residents living in the Wheatland Fire Protection District (East of Wheatland Center Road and outside the Mumford Fire District) pay approximately one half of the cost of “doing business”, they currently have NO vote in planning, spending, or debt. The Town reviews a budget proposal and determines whether to negotiate the cost or accept the proposal. NYS Law states that the cost is a “negotiated” cost.

Secondly, this proposal does not represent a quick nor recent process. There was consideration and a report conducted in 2009, a special advisory committee report in 2013 and the current 2019 – 2020 planning sessions. All these activities were driven by the concern in volunteer recruitment, increased costs of doing business and a long- range perspective of how to continue to provide service locally. In our Town and in our Village, one must also determine what is a reasonable response time to any emergency event whether it be fire or medical. The question became, how can we best continue to take care of ourselves in the most appropriate manner? Other options were discussed by the Supervisor, Mayor, Deputy Supervisor, Deputy Mayor and both attorneys along with Scottsville Fire Department leadership. It was determined that we have the positive opportunity to continue to provide local service, with local volunteers, paid for by the same people who currently pay for the service. The only change is administrative. The current debt will eventually be transferred to the newly created district and out of the Village budget, the debt remains paid for by the same people as now, the equipment which was paid for by the same people is turned over to the district to serve the same people, the clerical services paid to the Village front office is instead paid to a district treasurer/secretary. Again, merely a “redesign” and not a fundamental change. There is no impact on service delivery.

The most significant change is the following: Village government no longer “runs” the fire department nor budgets for the cost on their taxes. The fire department becomes its own taxing authority just like the Town, the Village, the School and the Mumford Fire District. The Town does not “gain” anything from this proposal. The Town government has the obligation by NYS Law to provide the tax collecting service. Once we receive the district budget, we notify the County what figure to put on the bill, our tax collector collects the taxes, and the supervisor signs a check turning the money over to the fire district. The Town is merely the “flow through” for monies from Village residents and former Wheatland Fire Protection residents to the new joint district. This joint fire district is not part of Town government. The newly created district answers directly to the people of the Village and people of the current Wheatland Fire Protection District without going through the Village government as is currently the process. The residents served by the joint district will vote on commissioners who develop the budget and plan for future needs

Thirdly, all discussion as to the debt the Village currently has for the fire department has followed a two – track process. One track was if our Senator and Assemblywoman can successfully pass special legislation in Albany, then the debt would be transferred to the new district as soon as they can secure financing. The same dollar figure as the Village currently has as debt. If Albany is not able to respond in time, then the Village will continue to hold the debt but will receive a check from the new district to pay that debt as soon as taxes for the district are collected. Again, the same people/residents paying the same amount as in 2020. Any projections of future costs of the district beyond 2020 is a process of the newly appointed, and later elected, district fire commissioners.

When it comes to the Fire Pavilion, that is neither owned by the Scottsville Fire Department nor the Village of Scottsville. It is owned by the Scottsville Fire Company. It does, however, sit on land currently owned by the Village. The Village has agreed to deed the land over to the Fire Company so that the building and the land will be owned by the same entity. A nominal fee will be set by the Village.

Historically, fire departments across New York State are moving to the district model and not remaining under Villages. Towns are NOT permitted to have fire departments per New York State Laws. Although we are required to provide fire service to our residents a Town must contract for such services and not deliver them ourselves. We cannot own the equipment nor hire the staff. We do have the duty to collect the taxes for a fire district.

It is anticipated that the proposed joint district will provide increased accountability to the public, will be more transparent to the taxpayer (currently is within the Village budget and bills), is required to be audited by NYS annually (is not true in the current design), and better enable planning for the future.

MONROE COUNTY. NEW YORK

  1. This is the Descriptive Summary of the Dissolution Plan of the Wheatland Fire Protection District endorsed by the Town of Wheatland Town Board on July 16th, 2020.
  2. The Wheatland Fire Protection District, within the Town of Wheatland (Town), Monroe County, New York proposes to be dissolved.
  3. The territorial boundaries of the Wheatland Fire Protection District are the entire Town of Wheatland 1) excluding the entire geographic area of the Mumford Fire District and the Village of Scottsville, 2) bounded on the north to the southern boundary of the Town of Chili and the Clifton Fire Protection District; 3) bounded on the east by the western boundary of the Towns of Rush and Henrietta, and 4) bonded on the south at the Monroe County Livingston County Line.
  4. The cost of the dissolution would be nominal. The Town will be utilizing some of the town paid staff who are on payroll, this sum being part of the normal operating budget of the Town of Wheatland. a. After its dissolution, the Town of Wheatland will no longer be required to include appropriations for the Wheatland Fire Protection District. b. This dissolution is conditioned upon the establishment of the Wheatland-Scottsville Joint Fire District.
  5. The Wheatland Fire Protection District has no employees, and thus there be no transfer or elimination of public employees.
  6. The Wheatland Fire Protection District has no assets, owns no real and personal property, has no liabilities or indebtedness. As a result of this dissolution, there will be no disposition of the Wheatland Fire Protection District or these assets, property, liabilities, and indebtedness, including the need to levy and collect any necessary taxes.
  7. The Town of Wheatland and the Village of Scottsville have entered into an agreement for coordinated review under the State Environmental Quality Review Act with the Town of Wheatland being the lead agent pursuant to SEQRA.
  8. The residents who were in the Wheatland Fire Protection District after dissolution, as before the dissolution, will continued to be furnished fire protection by the Scottville Fire Department, Inc.
  9. Both the establishment of the Wheatland Scottsville Fire District and the Dissolution of the Wheatland Fire Protection District will have public hearings.
  10. There are no rules or regulations of the Wheatland Fire Protection District that will remain in effect after the effective date of the dissolution.
  11. The effective date of the proposed dissolution is December 31, 2020 at 11:59 P.M.
  12. This dissolution of the Wheatland Fire Protection District is conditioned upon and dependent upon the establishment of the Wheatland-Scottsville Joint Fire District.
  13. A public hearing will be held on this proposed dissolution plan at the Town of Wheatland Town Hall, 123 Main Street, Scottsville, New York,14546 on August 20, 2020 at 6:00 p.m.

Summer Day Camp 2020 Registration Open

Wheatland Recreation Summer Camp offers a range of activities and experiences as well as a social interaction. At camp the kids stay active in a safe setting as our program is certified with the Monroe County Health Department. We have CPR & First Aid certified counselors and will maintain a staff ratio of approximately 1:7 due to the new COVID-19 guideline. The kids will be in groups of 10-15 with 2 counselors for the entire week. The interaction between groups will be minimal and social distancing will be practiced whenever possible. We are excited to be able to offer this opportunity this summer for games, crafts, athletics, socialization, new friendships and much more fun! Please note that due to COVID –19 the NYS DOH regulations and procedures will take precedent over our regular rules and procedures and all are subject to change.

On Saturday, June 6, 2020 and Saturday, June 13, 2020 between the hours of 8 A.M. and 3 P.M. there will be dumpsters placed at the Highway Building, 1822 Scottsville-Mumford Road. Town Outside Village Residents may bring trash to this location to dump in hoppers provided. Due to covid-19 masks will be required at all times.

Proof of residency will be required. New York State driver’s license is acceptable.

Recycling of electronics will also be available. All electronics can be recycled free of charge.

BRUSH, TIRES, FUEL OIL, GASOLINE DRUMS, REFRIGERATORS, FREEZERS OR PAINT CONTAINERS WILL NOT BE ACCEPTED. DUMPSTERS WILL BE MANNED FOR ASSISTANCE.

Virtual Gentle Yoga Class

heatland Recreation is excited to announce our Virtual Gentle Yoga Class. This class will be held weekly via Zoom. This program provides a style of yoga that is less strenuous than other forms of yoga. Very useful for beginners, seniors, pregnant women, those who are recovering from injury or those looking for a more relaxed workout. Gentle yoga can also be beneficial to those who already are fit but lack overall flexibility.

Appropriate Usage of Town Property

With the approaching Spring and Summer nice weather, I would like to remind our residents about the policies related to the resident’s access and use of the Town property located @ 1421 Scottsville – Mumford Road. Please note the following:

  1. This site is made available to Town of Wheatland, Outside of the Village of Scottsville residents only. Village of Scottsville residents should contact the Village office or the Village DPW for drop off at their site. Village of Scottsville tax dollars do not support the maintenance of the Town site
  2. The Town site is for yard debris, brush, wood chips, lawn clippings, leaves, and other similar items
  3. Building and construction debris is NOT PERMITTED. This would include items such as fencing, concrete blocks, asphalt, lumber, etc.
  4. Removing stone, millings and topsoil FROM the Town site is ONLY permitted with approval of the Town Highway Superintendent.
  5. If a Town Outside of the Village resident has hired a landscape company and been charged for disposal, it does NOT come to the Town site. Such practice has occurred with the cost then being born by all Town outside of the Village residents when it is time to clean up the site.
  6. NO landscape companies are permitted to enter and dispose of spoils and debris on the Town land without permission of the Highway Superintendent.

The Town Supervisor and Highway Superintendent would like to keep this property open and accessible to the public, but with continued misuse, the current ability to access on your schedule could be limited or eliminated. We encourage everyone to abide by the above policies and report any observed or suspected misuse of our trust and facility. A name or license plate number is always helpful in reaching out to the individual or company. Such a situation was observed and called out by the Supervisor last year. It turned out to be a landscape company from another town not even doing work in Wheatland. Please help us to maintain our current practice. Thank you for you cooperation.
